The DDPA writes to TDs regarding the Planning and Development Bill 2022

The DDPA has written a letter that was sent to all current TDs to express concern about parts of the Planning and Development Bill 2022.


Although, certain aspects of the Bill were welcomed by the DDPA, we expressed alarm at the number of last-minute amendments that were made to it by the Minister for Minister for Housing, Local Government and Heritage, Darragh O'Brien TD.


Particular concern was expressed at amendments that

...undermine the citizens' rights to access to justice and are contrary to the letter and spirit of the Aarhus Convention. They also threaten the separation of powers - the foundation of the stability of our state.

This includes amendments intent on

  • Limiting the jurisdiction of the Court to grant leave;

  • Removing the discretion from the Court to remit; and

  • Permitting the amendment of a planning decision after leave has been sought to the Court.
